ELIGIBILITY: Open to residents of N.C. and S.C. who are 18 years of age or older at time of entry. Independent contractors associated with and employees of Allen Tate Company (the "Sponsor") and employees of Sponsor's affiliates, subsidiaries, agents, dealers, advertising and promotion agencies, prize suppliers, and participating advertisers, and the immediate family members or persons residing in the same household of such employees are not eligible to enter or win.
HOW TO ENTER: To enter the Allen Tate Realtors' Ultimate Fan Package Sweepstakes (the "Sweepstakes"), enter online at www.allentate.com by completing the online entry form or stop by any Allen Tate office in NC or SC and an agent can assist you in signing up online. The Sweepstakes begins October 15, 2009 and ends November 15, 2009. All entries must be submitted by November 15, 2009 at midnight ET. Limit one entry per person and per email address. Once submitted, entries become the exclusive property of the Sponsor and will not be returned. With respect to online entries, Sponsor not responsible for computer system, phone line, technical, hardware, software or program failures of any kind, lost or unavailable network connections, incomplete, garbled or delayed computer transmission or network connections that are human or technical in nature. Contestants must provide a valid e-mail address. Internet entries will be declared made by the "Authorized Account Holder" of the e-mail address who submitted the Official Online Entry Form. An "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address no later than November 15, 2009, by an internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor is not responsible for late, lost, damaged, misdirected, mutilated, stolen, incomplete or illegible entries. No photocopies or mechanically reproduced entries are permitted. Incomplete, incoherent, illegible or late entries will be disqualified. Entrants agree to be bound by these Official Rules and by the decisions of the judges, which are final and binding in all respects. PRIZES/ODDS: One (1) Grand Prize will be awarded. Grand Prize is 4 Lower-Level tickets and 4 Field Passes to the Jan. 3, 2010 Carolina Panthers game at Bank of America Stadium, Charlotte, NC, a signed, framed Carolina Panthers jersey and a 42-inch LG Plasma HDTV. (Approximate retail value of Grand Prize: $ 1, 760.00). The Grand Prize will be awarded on or before December 4, 2009. Odds of winning depend on the number of eligible entries received. Each eligible entry will have an equal chance of winning.
WINNERS SELECTION/ PRIZE REDEMPTION: The drawing for the winner will be held in Charlotte, North Carolina on or about November 17, 2009. Potential prize winner will be notified by telephone or email. All taxes on prizes are the sole responsibility of the winner. Winner must complete and return an Affidavit of Eligibility and Liability Release within ten (10) days of notification or prize will be forfeited and an alternate winner will be selected. If prize/prize notification is returned as undeliverable, the prize will be forfeited and an alternate winner will be selected. Unclaimed prizes may not be awarded.
GENERAL: Prize is non-transferable. All taxes or expenses and any costs incurred in claiming or using any of the prizes, are the sole responsibility of the prize winner. All federal, state and local taxes are the sole responsibility of the winner. Because the prize is greater than $600, Sponsor will issue an IRS 1099 tax form to the Grand Prize winner. No prize substitutions, except at Sponsor's sole discretion, and then only for a prize of equal or greater value. This Sweepstakes is subject to all applicable federal state, and local laws and regulations. Limit one (1) prize per household. Acceptance of the prize constitutes permission to the Sponsor and its agencies to use the winner's name, address (city and state only), likeness, and statements attributed to him/her for the purpose of advertising and trade, in any media now existing or hereinafter devised, on behalf of the Sponsor and all Sponsor affiliates without further permission or compensation, except where prohibited by law. By participating, entrants agree to be bound by these Official Rules and agree to release and hold harmless the Sponsor and all Sponsor affiliates and each of their respective employees, shareholders, agents, officers, and directors from and against any and all liability claims, losses, and/or damages including without limitation, any injury, death and/or disability caused by, contributed to by, or arising out their participation in this Sweepstakes, any related travel, acceptance, possession, use or misuse of the prize. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Sponsor reserves the right, in its sole discretion, to: (i) disqualify from this or any sweepstakes it sponsors now, or in the future, any person it finds, in its sole discretion, has intentionally violated these Official Rules, tampered with the entry process, the operation of the Sweepstakes, or any other aspect of this Sweepstakes; and (ii) cancel or suspend part or all of this Sweepstakes in the event that printing errors, tampering, fraud, unauthorized intervention or other causes beyond Sponsor's control, corrupt or impair the administration, security, fairness or proper play of the Sweepstakes. In such event, Sponsor may award prizes in a random drawing from all eligible entries received prior to the date of cancellation or suspension. The Sponsor and all Sponsor Affiliates and each of their respective employers, shareholders, agents, officers, and directors assume no responsibility for inaccurate information of any kind, whether caused by equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error, which may occur in the processing or submission in the Sweepstakes.
By participating, entrants agree to be bound by these Official Rules and agree to release and hold harmless the Sponsor, the National Football League and its member clubs, and all of their respective affiliates, and each of their respective employees, shareholders, agents, officers, and directors from and against any and all liability claims, losses, and/or damages including without limitation, any injury, death and/or disability caused by, contributed to by, or arising out their participation in this Sweepstakes, any related travel, acceptance, possession, use or misuse of the prize.
WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, GENERAL MILLS RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS' FEES), FROM ANY SUCH ENTRANT OR OTHER PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
